You may be cheap, and you may not want to spend a few bucks on a battery case, but don't cry when the battery makes contact with loose change or keys in your pocket, and explodes.
The FDA's new regulations don't prohibit shops instructing clients about any of their devices. The shops can't make any modifications to devices (unless they apply to be a tobacco manufacturer) but they can instruct customers.
